Service Advisor for Dealership Exempt from FLSA Overtime Rules

The Fourth Circuit has found that a service advisor for a Ford dealership was exempt from the FLSA's overtime provisions. The court agreed that the service advisor was a "salesman" and affirmed the district court's grant of summary judgment.

The Court found that as a service advisor, he promoted and attempted to sell goods and services provided by the dealership, had sales objectives, had to provide estimates for service and sell proper repairs and/or services that would meet customer needs. The Court concluded he was a salesman under the statute, an integral part of the dealership's servicing of automobiles, and that the district court correctly concluded that his job activities exempted him from the FLSA's overtime provisions.
