Borrowing a page from the OFCCP, the EEOC implemented a Systemic Discrimination initiative in 2006 that is beginning to have a profound impact on employers across the country.
However, many employers, unaware of these important changes, continue to defend OFCCP audits and EEOC charges by focusing primarily on technical compliance and single claimant issues. The result has been a big jump in EEOC and OFCCP class-based claims and record-setting monetary settlements.
