Hiring Reporting Requirements / Garnishments - Canada

There is no Canadian legislative equivalent to the United States' Personal Responsibility and Work Opportunity Reconciliation Act of 1996 which requires employers to report information on new hires.

However, various provinces have legislation allowing creditors and government agencies to obtain court orders or administrative directives that direct employers to garnish payments from employees' wages for certain purposes, such as the payment of child support arrears.

While employers should generally comply with a garnishment order, such compliance should not be automatic. Any employer receiving a request from a third party for deductions from an employee's pay should first consult a lawyer to ensure the legality of the request, and the authenticity of the documents.
