Nevada Passes New Law Protecting Pregnant Employees

On June 2, 2017, the Governor of Nevada signed into law Senate Bill No. 253, which greatly expands the legal protections for pregnant employees. The Nevada Pregnant Workers’ Fairness Act makes it an unlawful employment practice for an employer to refuse to provide a reasonable accommodation to a female employee or applicant for a condition relating to pregnancy, childbirth or a related medical condition. It is also an unlawful employment practice to take adverse action against, or deny an employment opportunity to, an otherwise qualified female employee or applicant due to a request for, or use of, a reasonable accommodation.
The Nevada Pregnant Workers’ Fairness Act requires the employer and employee to engage in a “good faith and interactive process” to determine an effective and reasonable accommodation. Notice provisions of the Act are effective June 2, 2017, and other parts of the Act are effective October 1, 2017.
