$3 Million Jury Award When Supervisors Fail to Accommodate Allergies

In California a jury has handed down a $3 million award to a California Department of Transportation employee in a case alleging harassment and failure to accommodate a disability. John Barrie, a staff services analyst with the State of California, alleged his supervisors harassed him by intentionally triggering his allergies through exposure to chemicals such as perfumes and cleaning solutions.  Mr. Barrie's allergies were accommodated when he started working for the State, but later a new supervisor rescinded the accommodation.  Mr. Barrie was allegedly harassed and perfume and cleaning chemicals were sprayed in his office.
