Oregon Governor Kate Brown has signed a law which prohibits pay bias on the basis of race, color, religion, sex, sexual orientation, national origin, marital status, veteran status, disability, or age. Also, employers can only ask about salary if it is after a job offer that includes a wage amount.
The law provides for significant potential damages against employers. However, it also provides for a defense that employers can use if they show they have conducted an appropriate equal pay analysis of its pay practices and that it has eliminated wage differentials. The bulk of the law will be effective on January 1, 2019.
