On October 4, 2017, Attorney General Jeff Sessions changed the Department of Justice’s position that gender identity is protected as part of Title VII of the Civil Rights Act’s prohibition against sex discrimination. Sessions stated that "Title VII does not prohibit discrimination based on gender identity, per se".
This is contrary to the EEOC's position. The EEOC is primarily responsible for enforcing Title VII. The EEOC has stated definitively that it interprets Title VII’s prohibition on sex discrimination as encompassing employment discrimination based on gender identity and sexual orientation.
